Regulation of businesses

Applies from 1 February 2008

New regulations have been drafted that aim to reduce the numbers of people who are diagnosed with melanomas and other sun-related skin cancers.

Compulory warnings

Businesses like solariums, beauty salons and gyms will have to provide health warnings to people who use their sun beds (equipment that exposes people to ultraviolet light to produce a sun tan). 

The warnings have to inform users about the dangers of radiation exposure from sun tan units and that the following groups are prohibited from using sun beds: 

  • young people aged under 18 unless they have consent from a parent or guardian.
  • children under 16
  • people with fair skin that burns without tanning.

These businesses will have to be licensed and audited to make sure that they comply with their licence conditions.

Penalties

If organisations fail to register, they face a maximum penalty of $991.080. (link to Victorian Health for more information about penalties).  
Individuals can be fined up to $132,000 if they do not follow the regulations when they use the sun-tanning units.
