Driving across train or tram tracks – new law

It is an offence to deliberately or recklessly cross train or tram tracks when warning bells, boom gates or warning lights have signaled that it is not safe to cross.

The offence also applies to drivers who attempt to cross tracks when the road ahead is blocked.

This is a 'relevant offence' under the hoon driving laws.

Penalties

Drivers who are convicted of this offence may be fined up to 30 penalty units (link to penalty units information below).

Courts have no discretion and must also cancel the driver’s licence and disqualify them from driving for at least three months if they are convicted of this offence.

The vehicle that was involved in the offence may also immobilised, impounded or confiscated under the hoon driving laws.
