Expansion of matters in which summary crime youth certifiers can act

To ensure that ongoing high-quality representation for our clients can continue owing to the changes brought about by the Children and Justice Legislation Amendment (Youth Justice Reform) Act 2017, Victoria Legal Aid (VLA) has expanded the range of offences in which Youth Crime Subset certifiers of the S29A Summary Crime Panel can act in the higher courts.

The changes

Youth Crime subset certifiers of VLA’s S29A Summary Crime Panel can now act in the following matters in the higher Courts:

  • uplifted sex offences
  • Category A and Category B offences (as defined in the Children Youth and Families Act 2005), except where the offence is against Division 101 of the Commonwealth Criminal Code.

What has not changed

Only Youth Crime subset certifiers of VLA’s S29A Indictable Crime Panel can act for children who are charged with an offence involving the death of a person, or in matters where the child is charged with a terrorism offence under Commonwealth Law.

Changes to Atlas

New ATLAS templates for uplifted matters have appeared on your ATLAS Home Page. Please use the ‘Youth – Indictable (offences that cannot be determined summarily)’ template to select funding.

Where the proceedings (excluding matters involving the death of a person, or involving offences against Division 101 of the Commonwealth Criminal Code) are uplifted to be determined in the County or Supreme Court, Youth Crime Subset Certifiers will now be able to use the ‘Youth – indictable (offences that cannot be determined summarily)’ template to select the appropriate funding.

Where you have selected Children’s Court as the hearing location, you will now be able to select funding for committal and/or plea in the County or Supreme Court. Where the matter proceeds to a higher court for trial, you will now be able to select County Court or Supreme Court trial funding.

Indictable Crime Subset Certifiers’ template and funding access has not been changed.
