Recovering costs helps us fund more matters

It is a condition of a grant of legal assistance that costs orders, including Appeal Costs Certificates, are sought where appropriate.

Seeking and recovering costs helps us to assist as many people as possible by allowing us to fund more matters. It also reduces the contribution paid by clients toward the cost of their legal assistance, including where that cost is secured by an equitable charge on a client’s property.

It is important that you let us know as soon as a costs order has been made or an Appeal Costs Certificate has been granted, and to provide a copy of the order or certificate, so that we can take steps to recover the costs.

Specific time limits for Appeal Costs Certificates apply. Applications must be made to the Appeal Costs Board within 12 months of the final determination of the matter or the certificate will expire. Consequently, it is important to submit your applications to the Appeal Costs Board as soon as possible.
