Standardising duty lawyer fees in child protection

Our Child Protection Transformation activities are underway and gaining momentum through various projects identified by the 2017 Child Protection Legal Aid Services Review.

As part of the work, a review of the child protection program's duty lawyer fees has highlighted a discrepancy between the rates we pay to s. 29a panel private practitioners and the rate for barristers.

The panel rate is capped at $785, while barristers are paid $711, the equivalent of a one day contest rate.

From 1 June 2018 we propose to standardise the duty lawyer fees, aligning barristers' duty payments to the private practitioner capped rate of $785.
