From 20 March 2021 the County Court is introducing an Interim Active Case Management model system (ACMS) for new initiations.

We are committed to ensuring matters progress in a timely manner and that where possible, efforts towards resolution are supported. Accordingly, new initiations that aredealt with through the interim ACMS model will attract the same  fees that were announced last year to support Phases 2 to 5 of the Emergency Case Management System. These fees are payable until 30 June 2021.

Some matters will continue to be covered by Phases 1–5 of the Emergency Case Management model which was introduced last year for pending trials that were delayed or vacated due to COVID-19.

Interim ACMS and emergency  case management – phases 2 to 5 matters

There will be a single Case Conference fee that applies regardless of what takes place at the hearing (ie if resolution discussions, or a sentence indication, or pre-trial occur the single case conference fee will apply).

Phase 1 matters

The fee that applies to these case conferences will be determined by how the hearing eventuated. For example if a resolution discussion hearing becomes a sentence indication then the sentence indication fee would apply. To support this you will be able to make retrospective applications in these instances as we understand practitioners may not know what aid is needed prior to the hearing.

Our current special hearing interim fees will be expanded to all cases where pre-trial examination will take place (until 30 June 2021) as special disbursements
