We recently revised our special circumstances guideline to make it clearer, more consistent, and easier to apply.

We have now introduced notes providing guidance on how the special circumstances guideline in the Handbook for Lawyers is interpreted and applied.

The notes on the special circumstances guideline provide commentary and examples of:

  • eligibility criteria – an explanation of what is required to meet the criteria for eligibility under the special circumstances guideline.
  • documentary requirements – the documents required to be retained on the file (or uploaded to ATLAS where we assess eligibility) as evidence of compliance with the guidelines.
